APPLICABILITY OF FINANCIAL DISCLOSURE LAW TO EXECUTIVE DIRECTOR OF MENTAL HEALTH CENTER

SUMMARY:

 

The executive director of a mental health center contracting with a district mental health board to provide community mental health services is not required to file financial disclosure pursuant to Section 112.3145, Florida Statutes. CEO 77-136 is referenced.

 

QUESTION:

 

Are you, the executive director of a nonprofit corporation which provides community mental health services, required to file financial disclosure pursuant to Section 112.3145, Florida Statutes?

 

Your question is answered in the negative.

 

In your letter of inquiry and in a telephone conversation with our staff, you advised that you are the Executive Director of the Seminole County Mental Health Center, Inc., which is a nonprofit corporation providing community mental health services to the public under a contract with the District Mental Health Board. You also advised that the Mental Health Center trains and supervises interns from the University of Central Florida and provides most of the other direct services generally provided by community mental health centers.

In a previous advisory opinion, CEO 77-136, we advised that the members of the Board of Directors of a nonprofit corporation contracting with a district mental health board to provide mental health services were not required to file financial disclosure. Similarly, here, we are of the opinion that the Executive Director of such an organization also is not in a position which requires the filing of a statement of financial interests under Section 112.3145, Florida Statutes.

Accordingly, we find that you are not required to file financial disclosure under Section 112.3145, Florida Statutes, by virtue of your position as Executive Director of the Mental Health Center.
